Where Can You Vape in Spain? Bars, Terraces, Beaches and Transport

The short answer

Outdoors, almost always yes. Indoors in public spaces, almost never. And between those two there's a grey band that depends on which part of Spain you're in.

The rule that explains everything else

Before going location by location, hold on to this: each autonomous community can tighten the national rules, but cannot loosen them.

That's why "can I vape on a terrace?" has a different answer in Vigo than in Barcelona. The national floor is shared; each region builds on top of it.

Indoors: the easy part

Vaping is prohibited in any enclosed space in public use. No exceptions, no designated areas:

• Inside bars, restaurants and cafés
• Nightclubs and music venues
• Shops and shopping centres
• Healthcare settings and hospitals
• Schools and universities
• Public administration buildings
• Workplaces
• Any enclosed space where minors are present

An empty venue, a late hour, or an owner saying they don't mind doesn't change the rule.

Terraces: where the confusion lives

This is the most-asked question, and the answer depends on where you are.

And above all of it: the venue decides. A terrace is private property in public use. Even where the law allows it, the establishment can say no.

A "closed" terrace — side awnings down, roof on — functions as an indoor space under most readings. If it's enclosed on three or four sides, treat it as indoors.

Beaches

There is no national ban. It's a municipal decision, and a growing number of coastal councils have declared their beaches smoke-free.

Barcelona is worth knowing about, because most sources have it out of date. The city banned smoking on its beaches by ordinance in 2022, vapes included. That part was challenged, and the Tribunal Superior de Justícia de Catalunya overturned it — the council does not have the authority to regulate vaping devices that way. Cigarettes remain banned; vaping does not.

Signage on many beaches doesn't reflect that. If you're asked to stop, stop.

Transport

Airports: no, anywhere. Spanish airports have no smoking rooms.

Aircraft: no, and the device travels in hand luggage, never checked. That's a lithium battery safety rule.

Train, metro and bus: no — not in vehicles, not on covered platforms, not in enclosed stations.

Taxis and ride-hailing: no. They're vehicles in public service.

Your own car

Permitted, with two caveats worth taking seriously.

Alone or with adults, the law doesn't prohibit it. But the DGT can penalise distracted driving if handling the device takes your attention off the road — the same as a cigarette or a phone.

Vapour also fogs the glass. In a closed car it cuts visibility more than people expect.

With minors on board: there's no explicit national prohibition, but it's precisely the behaviour the 2026 bill sets out to regulate.

Hotels

Each hotel sets its own policy. Most treat vaping as smoking, and a cleaning charge for vaping in a non-smoking room is common — anywhere from fifty euros to several hundred.

Vapour doesn't leave the lingering smell tobacco does, but it does leave residue on surfaces and in detectors. Ask at reception.

What the 2026 bill would change

On 21 July 2026 the Council of Ministers approved a draft bill updating the 2005 tobacco law and sent it to parliament.

If passed, it would extend smoke-free rules to hostelry terraces, beaches, pools, university campuses, sports facilities, national parks and transport vehicles, treating vaping on a par with tobacco in all of them.

It is not in force. Parliamentary processing remains open, with consideration expected before summer 2027. Any article saying vaping is already banned on terraces and beaches nationally is describing a bill, not a law.

It also does not include a disposables ban, despite widespread reporting to the contrary. That was left out of the approved text, to be added later.

Frequently asked questions

Can I vape on a bar terrace?
Depends on the region and the venue. Not in Galicia. In Catalonia the establishment decides. In most of the rest, outdoors is fine.

What about at work?
Not indoors. Some employers provide outdoor areas; that's their choice, not a legal requirement.

Can I vape walking down the street?
Yes. Open spaces aren't restricted, except around healthcare and education sites in some regions.

Is it different if the vape is nicotine-free?
For where you can vape, no — location rules apply the same. The 0 mg difference is in product limits, not usage.

What's the fine?
It depends on the rule broken and the region. In practice, being asked to stop is far more common than being penalised.

Can I vape in a children's play area?
Several regions prohibit it in play areas. Regardless of the rule, it's one of the places it goes down worst.
